A Federal High Court sitting in Ibadan, Oyo state, on Wednesday set aside a letter by the Economic and Financial Crimes Commission, EFCC, asking the Oyo state Accountant-General, Kikelomo Adegoke to furnish the Commission with details of payments to Contractors from 2021 to date.
The Oyo state Government had through the office of the Attorney General and Commissioner for Justice, asked the court to set aside the letter on the grounds that the request did not comply with certain provisions of the EFCC Act and the Constitution of the Federal Republic of Nigeria.
The Plaintiffs argued that such requests from the EFCC ought to clearly stated that the information required is tied to specific allegations and investigation.
They argued further that the letter in question was nebulous.
While agreeing with the Plaintiffs, the Court observed that the letter in question does not comply with certain provisions the EFCC Act and other relevant Laws.
The Court however maintains that the judgment should not be misinterpreted to mean that the court can interfere with the powers of the EFCC to investigate the Government of Oyo state.
No order was made against the Anti-graft Agency.
